Terms of Service

1. Acceptance of terms

By accessing or using Steward Brand (the "Service"), operated by Mário Filipe Vicente de Mineiro as a sole proprietorship, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Steward Brand is a multi-tenant platform that lets you connect social media accounts, generate AI-assisted content, schedule posts, and analyze performance metrics across Facebook, Instagram, LinkedIn (personal and Pages), TikTok, and YouTube.

3. Eligibility

You must be at least 16 years old (or the digital-consent age in your jurisdiction) and legally able to enter into a binding contract. The Service is not available to anyone previously suspended by us or by a connected platform.

4. Account registration

You agree to provide accurate, current, and complete information when registering, and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at stewardbrandofficial@gmail.com if you suspect unauthorized access.

5. Acceptable use

You agree to use the Service only for lawful purposes and in compliance with these Terms, all applicable laws, and the developer policies of every platform you connect (Meta Platform Terms, LinkedIn API Terms of Use, TikTok Developer Terms, YouTube API Services Terms of Service). You must not:

• Publish content that is unlawful, infringing, defamatory, harassing, hateful, or sexually explicit involving minors
• Use the Service to send spam, run engagement-pod schemes, or artificially inflate metrics
• Impersonate any person or entity, or misrepresent your affiliation with one
• Attempt to gain unauthorized access to other accounts, tenants, or systems
• Reverse-engineer, decompile, or attempt to derive source code from the Service
• Use the Service to violate any platform's content, advertising, or community policies
• Resell or sublicense the Service without our written consent

6. Third-party platform connections

When you connect a social media account, you grant us permission to act on that account on your behalf strictly within the OAuth scopes you authorize. You remain solely responsible for all content published. We do not store platform passwords. You can revoke our access at any time from the Connections page in the app or directly from each platform's app settings. Each connected platform's own terms apply to your use of that platform.

7. AI-generated content

The Service uses third-party AI models to draft content suggestions. AI output may be inaccurate, outdated, biased, or unsuitable. You are responsible for reviewing, editing, approving, and ensuring the legality and appropriateness of every piece of content before it is published. We disclaim warranties regarding the quality, accuracy, fitness, or non-infringement of AI-generated content. You retain ownership of approved content; we claim no ownership over outputs you publish.

8. Intellectual property

You retain all ownership rights to content you create or upload. By using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, display, and modify your content solely as necessary to operate the Service (including transmitting it to the platforms you connect and the AI providers you configure). The Service itself, including its software, design, and trademarks, is our exclusive property.

9. Fees and billing

Some features of the Service may be offered as paid plans. Fees, billing cycles, and refund terms will be presented before you subscribe. Taxes are your responsibility unless otherwise stated. AI generation costs incurred via your own provider keys are billed by the AI provider directly to you.

10. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, violate a connected platform's policies, abuse the Service, or fail to pay applicable fees. You may terminate at any time by deleting your account from the data-deletion page or by emailing stewardbrandofficial@gmail.com. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE PUBLISHED ON TIME OR AT ALL.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (b) ONE HUNDRED EUROS (€100). NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless Mário Filipe Vicente de Mineiro from any claim, damage, loss, or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or your violation of any third-party right or applicable law.

14. Governing law and jurisdiction

These Terms are governed by the laws of Portugal, without regard to its conflict-of-laws rules. Disputes shall be submitted to the exclusive jurisdiction of the courts of Lisbon, Portugal, except where mandatory consumer-protection laws of your country of residence provide otherwise.

15. Changes to these terms

We may update these Terms. Material changes will be announced by email and the effective date above will be updated. Continued use after the new effective date constitutes acceptance.
